By accessing or using TideyCrew ("Service," "Platform," or "Application"), operated by Twin Paddlesports Ltd., a company incorporated in Canada, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all users, including but not limited to athletes, coaches, team administrators, club administrators, and visitors to the Platform.
TideyCrew is a web-based platform designed for paddling teams (dragon boat, outrigger canoe, and other paddling sports) to manage:
TideyCrew is available as a website and as an installable mobile application. Where you install it from an app store, that store's own terms apply to the download in addition to these Terms.
To use TideyCrew, you must create an account. You agree to:
You must be at least 13 years of age to use TideyCrew. Some places set a higher age for agreeing to an online service on your own: in Quebec, a parent or guardian must consent for anyone under 14, and in parts of the European Union the age is as high as 16. If you are under the age that applies where you live, a parent or guardian must agree to these Terms on your behalf. By using the Service, you represent that you meet these age requirements.

You retain ownership of all content you submit to TideyCrew ("Your Content"), including:
By posting Your Content, you grant TideyCrew a worldwide, non-exclusive, royalty-free licence to use, store, display, reproduce, and distribute Your Content as necessary to provide the Service.
Where you upload a club or team logo, crest, or other team image, you additionally grant Twin Paddlesports Ltd. a worldwide, non-exclusive, royalty-free licence to display that image and the associated club or team name publicly, to identify you as a user of TideyCrew. This includes our website, app store listings, social media, presentations, printed material, and other promotional material.
By uploading a team logo you confirm that you are authorised to grant this licence on behalf of your club or team, and that the image does not infringe anyone else's rights.
This licence covers club and team branding only. It does not extend to member profile photos, individual names, or any team data. You may withdraw it at any time by emailing shamus.menard@tideycrew.com, and we will stop using the logo in material we publish from that point forward.
You are solely responsible for Your Content. You represent that:
We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using TideyCrew, you consent to our collection and use of information as described in the Privacy Policy.
Team administrators have access to member information necessary for team management. By joining a team, you consent to sharing your information with your team's administrators and coaches.
TideyCrew provides tools for tracking team finances, budgets, and payments between a team and its members. We are not a party to those payments and we do not process them. The financial features are for record-keeping purposes only.
You are responsible for ensuring the accuracy of all financial information entered into TideyCrew. We are not responsible for any financial errors or discrepancies.
TideyCrew does not provide financial advice. Any financial information or tools provided are for informational purposes only.
TideyCrew offers a free plan and several paid plans. Each paid plan is sold as an annual subscription in Canadian dollars and carries a limit on the number of active members a team or club may hold, along with access to particular features. The current plans, prices, and limits are shown on our pricing page, which forms part of these Terms.
Subscriptions are purchased and processed through Shopify. Shopify handles the payment and stores your payment details under its own terms and privacy policy. We do not receive or store your payment card details.
A plan is held by a team or a club rather than by an individual. The administrator who purchases a plan is responsible for payment, and is confirming that they are authorised to buy on behalf of that team or club.
We may offer a free trial of a paid plan. A trial gives full access to that plan's features for a set period and does not require payment to start. When the trial period ends, the team returns to the free plan unless a subscription has been purchased. We may change or withdraw trial offers at any time.
Paid subscriptions renew automatically each year at the then-current rate for your plan, unless you cancel before the renewal date. You can cancel at any time by contacting us at shamus.menard@tideycrew.com or through the subscription management link in your order confirmation email.
If you cancel, your plan stays active until the end of the period you have already paid for, and then returns to the free plan. If a payment fails and is not resolved, the subscription may be suspended and the team will return to the free plan.
Returning to the free plan does not delete your data. Features and member limits above the free plan's allowance become unavailable, and you may need to reduce your active member count to stay within the free limit. Your records remain in your account and become available again if you resubscribe.
Payments are non-refundable. Cancelling stops your next renewal rather than refunding the period you are currently in. Nothing here limits any refund or cancellation right you have under applicable consumer protection law.
We may change our prices. If a change affects your renewal, we will give you at least 30 days' notice by email before it takes effect, so you can cancel if you would rather not renew at the new rate. Where we have offered you a fixed founding rate, we will honour it for as long as your subscription remains active without interruption.
TideyCrew and its original content, features, and functionality are owned by Twin Paddlesports Ltd. and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.
The TideyCrew name, logo, and related marks are trademarks of Twin Paddlesports Ltd. You may not use these marks without our prior written permission. Nothing in these Terms transfers any rights in your own club or team marks to us, beyond the licence you grant in Section 6.3.
If you provide us with feedback, suggestions, or ideas about TideyCrew, you grant us the right to use them without compensation or attribution.
TideyCrew uses third-party services including:
These services have their own terms and privacy policies. We are not responsible for the practices of these third-party services.
We strive to keep TideyCrew available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.
TideyCrew is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, TideyCrew and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total liability for any claim arising from your use of TideyCrew shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to liability.
You agree to indemnify, defend, and hold harmless TideyCrew and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of British Columbia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in British Columbia, Canada.
Any disputes arising from these Terms or your use of TideyCrew shall be resolved in the courts of competent jurisdiction in British Columbia, Canada.
Before filing a formal dispute, you agree to first contact us to attempt to resolve the issue informally.
If we cannot resolve the dispute informally, any disputes shall be resolved through binding arbitration in accordance with the applicable arbitration rules, except where prohibited by law.
You agree to resolve disputes on an individual basis only and waive any right to bring claims as a class action, consolidated, or representative proceeding.
We reserve the right to modify these Terms at any time. We will notify users of significant changes by:
Your continued use of TideyCrew after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TideyCrew regarding the Service and supersede all prior agreements and understandings.
